1. INTRODUCTORY PROVISIONS
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") shall apply to online reservations of accommodation services provided by the Hotel Operator, the use of the Hotel Operator's online reservation system, the payment and cancellation terms for online reservations made by the Customer(s) through this website, as well as all other rights and obligations arising from the legal relationship resulting from the online reservation.
1.2 The Customer is only entitled to use online reservations if he/she agrees to these General Terms and Conditions. The Customer is advised, in his own interest, to familiarise himself with these General Terms and Conditions before making a reservation. In the event of repeated use of the online reservation service, the Customer is obliged to familiarise himself with the latest version of the General Terms and Conditions. The Hotel Operator reserves the right to unilaterally modify these General Terms and Conditions, which shall be effective from the date of their publication on the Hotel Operator's website. If the Customer does not agree with any of the provisions of these General Terms and Conditions, the Hotel Operator requests the Customer not to use the aforementioned online reservation system. By confirming the reservation, the Customer expresses his unreserved acceptance of these General Terms and Conditions.
1.3 Each Customer acknowledges that all prices and conditions of reservation and service provision apply exclusively to online reservations made through this website.
1.4 By using the online reservation system, the Customer declares that he/she is at least 18 years of age and is capable of acquiring rights and obligations in his/her own name.
2. RESERVATION
2.1 When booking online, the Customer has the possibility to search for currently available accommodation in the Hotel according to the requirements entered in the booking form (arrival date, departure date, room type, etc.).
2.2 When booking online, the Customer fills in all the required data after selecting all the dates for the beginning and end of the stay, room type, additional services, etc.
2.3 After filling in all the required data, making the payment in accordance with these General Terms and Conditions and verifying the data, a confirmation of the reservation with the reservation number will be sent immediately to the e-mail address provided by the Customer. The assigned reservation number is used to confirm the reservation, as contact information for any changes or cancellations of the reservation, and to confirm the arrival. For this reason, the client is obliged to keep the reservation number in a safe place.
3. PAYMENT TERMS
3.1 Payment for the stay reserved by the Customer for online reservations must be made in full by the Customer for online reservations using the credit card payment service (eCard). For this reason, the Customer's credit/debit card number is required when making an online reservation if payment is to be made by eCard. By confirming the reservation, the customer agrees to pay the full amount of the reserved stay in favour of the hotel operator (by deducting the price of the stay) and authorises the hotel operator to make this payment. The total price of the stay shall be paid immediately into the bank account of the Provider.
3.2 The procedure and activity of the Hotel Operator is based on ethical principles and respects the privacy of the Customer. The reservation system currently uses the most advanced encryption systems for sensitive data and information, which guarantees full security of the data provided when making a payment to the Customer.
3.3 The Customer authorises the Hotel Operator to verify the credit card/debit card information provided with the relevant call centre of the bank or company that issued the credit card/debit card.
3.4 Any changes to the online reservation made by the Customer may be made electronically by entering the Customer's e-mail address entered during the online reservation and the reservation number assigned to the Customer and sent to the Customer during the online reservation, or in writing, by telephone or by e-mail through the Reservations Department of the Hotel Operator on the telephone number +421 55 632 45 22 or +421 905 470 123, e-mail address: reception@hotelbankov.sk. When requesting a change to an online reservation, the Customer must always quote the reservation number assigned at the time of online reservation and sent to the Customer's e-mail address provided at the time of online reservation. If the Customer requests a change to an online reservation that cannot be accommodated due to capacity or other operational reasons, the Hotel Provider shall make every effort to accommodate the Customer's request, but the Hotel Provider shall not be obligated to accommodate the Customer's request to change the online reservation, and the Customer shall not be entitled to any damages or other payments from the Hotel Provider due to the impossibility of changing the online reservation made.
3.5 If the Customer withdraws from the contract and cancels the reservation, the Hotel Operator shall be entitled to a cancellation fee as follows
3.5.1 Cancellation fee for individual reservations:
No cancellation fee as standard from the date of order confirmation until 12:00 noon 1 day prior to the start of the stay.
For individual types of accommodation packages, the operator may specify different cancellation conditions. Detaliy is obliged to specify the details in the reservation conditions for each individual stay on the operator's website, where the client has the opportunity to familiarise himself/herself with them before purchasing the stay and to express his/her agreement with the cancellation conditions.
3.5. 2 Cancellation fees applicable to so-called promotional reservations and stays in special dates (stays reserved for use in special dates determined by the operator):
Cancellation fee
The total value of the reservation must be paid in full (100% deposit); a 100% cancellation fee will be charged from the date of order confirmation to the date of arrival.
The operator determines the dates of the so-called special dates in advance, so that the client has the opportunity to familiarise himself with the conditions in case of withdrawal from the contract and cancellation of the reservation, or in case of partial withdrawal from the contract and partial cancellation of the reservation or non-arrival of the booked stay. Special dates are listed in the reservation conditions of the given stay on the website of the operator, where the client has the opportunity to familiarise himself/herself with them before purchasing the stay and to express his/her agreement with the conditions of cancellation of the reservation. In case of non-arrival of the client for the reserved stay, the client is obliged to pay a cancellation fee in the amount of 100% of the price of the ordered and confirmed services.
3.5.3. An early booking is a booking made by the Customer at least 10 days before the date chosen by the Customer as the day of arrival, with simultaneous payment of the total price of the stay according to the offer made by the Provider. In case of non-arrival of the Customer for the booked stay within the so called early booking period, the Customer is obliged to pay a cancellation fee of 100% of the price of the ordered and confirmed services.
3.5.4 A group reservation is a reservation made for 10 or more people. Cancellation fees for group bookings are as follows
25% of the price of the ordered and confirmed services 20 - 14 days prior to the date of arrival
50% of ordered and confirmed services 13 - 7 days prior to arrival date
75% of the price of ordered and confirmed services 6-2 days prior to arrival date
100% of the price of ordered and confirmed services for 1 day and the day of arrival
3.6 In case of non-arrival of the Customer for the reserved stay, the Hotel Provider shall be entitled to a cancellation fee amounting to 100% of the price of the ordered and confirmed services.
3.7 In the event that the Customer withdraws from the contract and cancels the reservation, or in the event that the Customer partially withdraws from the contract and partially cancels the reservation, or in the event that the Customer fails to arrive for the reserved stay in the case of promotional stays (Article 6 of the GC), the hotel operator shall be entitled to a cancellation fee equal to 100% of the price of the ordered and confirmed services.
3.8 In the event that the Customer withdraws from the contract and cancels the reservation, or in the event that the Customer partially withdraws from the contract and partially cancels the reservation, or in the event that the Customer fails to arrive for the reserved stay in exceptional cases (illness, death, natural disaster, etc.), the hotel operator shall be entitled to a cancellation fee of 100% of the price of the ordered and confirmed services. ), the hotel operator shall be entitled to waive the right to the payment of the cancellation fee on the basis of the presentation of credible evidence of a serious reason for the customer's withdrawal from the contract and cancellation of the reservation, or the customer's partial withdrawal from the contract and partial cancellation of the reservation, or the customer's non-arrival for the reserved stay.
3.9. In case of the Customer's withdrawal from the contract and cancellation of the reservation, or the Customer's partial withdrawal from the contract and partial cancellation of the reservation, or the Customer's failure to arrive at the hotel, the hotel operator shall notify the Customer in writing or by e-mail of the operator's right to a cancellation fee and its amount in accordance with these GCTC within 14 days from the day of the Customer's withdrawal from the contract and cancellation of the reservation, or from the day of the Customer's partial withdrawal from the contract and partial cancellation of the reservation, or from the day of the start of the stay in case the Customer does not start the stay. By confirming the order and accepting these GCTC, the Customer agrees and acknowledges that the Hotel Provider is entitled to unilaterally set off the Customer's claim for reimbursement of the paid price of the stay in the event of the Customer's withdrawal from the contract and cancellation of the reservation, or the Customer's partial withdrawal from the contract and partial cancellation of the reservation, or the Customer's failure to appear at the Hotel Provider's claim for payment of the cancellation fee in the amount specified in these GCTC to the extent that these claims are covered, while the amount exceeding the mutual claims of the Customer and the Hotel Operator in favour of the Customer shall be paid by the Hotel Operator to the Customer by means of a non-cash bank transfer to the Customer's bank account from which the payment of the price of the stay was made when the stay was booked online, within 30 working days from the day following the day of the Customer's withdrawal from the contract and cancellation of the reservation, or the Customer's partial withdrawal from the contract and partial cancellation of the reservation, or the Customer's non-arrival. Bank charges related to the refund of the price of the Customer's stay shall be borne by the Customer.
4. SPECIAL PROVISIONS
4.1 In case of ambiguities or questions arising during the online reservation, the Customer is entitled to contact the reservation department of the Hotel Operator by telephone at the following numbers +421 55 632 45 22 or +421 905 470 123, or by e-mail: reception@hotelbankov.sk.
4.2 The check-in is possible on the day of the beginning of the stay according to the reservation from 14.00. The check-out is possible on the last day of the stay according to the reservation until 11.00.
4.3 In case of special requests (baby cot, late arrival or departure (late check-in or late check-out) or interest in booking additional services, the Customer is entitled to contact the Reservation Department of the Hotel Operator by phone at +421 55 632 45 22 or +421 905 470 123, e-mail address: reception@hotelbankov.sk.
4.4 The hotel operator is entitled to provide a discount for children under the age of 2 years, i.e. (from 0 to 2 years inclusive) 100% discount without the right to a bed or an extra bed.
5. PROTECTION OF PERSONAL DATA
5.1 The Hotel Operator processes the personal data of the Customer voluntarily provided in the reservation form, namely name, surname, address, country of residence, e-mail, telephone number, as the processing of such personal data is necessary for the reservation of accommodation services provided by the Hotel Operator and/or for the fulfilment of the Customer's request for information prior to the provision of accommodation services by the Hotel Operator, and for the fulfilment of the Hotel Operator's obligations imposed by generally binding legal regulations. The hotel operator shall process the personal data for the time necessary to fulfil the above-mentioned purpose of processing.
5.2 By ticking the relevant box before sending the reservation, the Customer may give his/her consent to receive information on news and special offers from the Hotel Operator (newsletter). By ticking this box, both the Customer and the person concerned freely and voluntarily grant the Hotel Operator, in accordance with the Personal Data Protection Act and the relevant EU legislation, their express consent to the processing of the e-mail address provided for marketing purposes - sending the newsletter by electronic mail (e-mails). This consent to the processing of personal data is given by the customer for a period of 5 years.
5.3 The Customer is responsible for the completeness, truthfulness and accuracy of the personal data provided. In the event of a change in the personal data provided, the Customer is obliged to notify the Hotel Operator of the change without delay.
5.4 The Customer may at any time revoke his or her consent to the processing of personal data for marketing purposes (for the sending of newsletters) by clicking on the relevant link contained directly in each marketing e-mail sent by the Hotel Operator, by sending an e-mail to the Hotel Operator or in person at the Hotel Reception.
5.5 The stored personal data shall be deleted if the personal data provided is out of date, if the consent to process the personal data is revoked, if the purpose or the period for which the consent to process the personal data was given has been fulfilled, or if the storage of the personal data is inadmissible for legal reasons.
5.6 The protection of personal data is governed by the provisions of the Personal Data Protection Act and relevant EU legislation, which also regulates the rights of the Client as a data subject. The Customer has the right to be informed, free of charge, about the processing of his/her stored data. Subject to the requirements of generally binding legal regulations, you also have the right to (i) access your personal data, (ii) correct any inaccurate personal data, (iii) restrict (block) the processing of your personal data, (iv) object to the processing of your personal data for direct marketing purposes, (v) delete your personal data, (v) the right to delete personal data, in particular if they are no longer necessary for the purposes for which they were collected or otherwise processed, or if you revoke your consent to their processing and there is no other legal basis for their processing, or if personal data have been processed unlawfully. The Customer also has the right to data portability, provided that the aforementioned conditions are met, i.e. the right to obtain in electronic form, in a structured, commonly used and machine-readable format, his/her personal data that he/she has voluntarily provided to the Hotel Operator, and to exercise his/her right to transfer such data to another Operator, provided that such transfer is technically possible (the right to data portability).
5.7 In the event that the Customer claims any of the rights of the data subject under the Personal Data Protection Act from the Hotel Provider and the identity of the applicant cannot be verified from the Customer's request, or the Hotel Provider has reasonable doubt about the identity of the applicant, the Hotel Provider reserves the right to request the applicant to provide additional information necessary to confirm the identity of the applicant.
5.8 The Guest, as the data subject, has the right to file a complaint with the supervisory authority, which is the Office for the Protection of Personal Data of the Slovak Republic, with its seat at Hraničná 12, 820 07 Bratislava, if he/she suspects that his/her personal data are being processed in violation of the applicable legislation.
5.9 The hotel operator hereby declares that it shall process personal data only for the purposes specified above and in accordance with the Personal Data Protection Act and relevant EU legislation, using appropriate technical, organisational and security measures.
5.10 To the extent necessary, the Customer's personal data may be provided to the Hotel's contractual service provider (to another third party - the recipient), if this is necessary to fulfil the purpose for which they were collected. Such a contractual service provider of the hotel operator is mainly a provider of marketing services, a bank, etc. The data may only be used by these service providers for the purpose for which the personal data was collected.
6. FINAL PROVISIONS
6.1 These Terms and Conditions and the legal relations arising from them shall be governed by the laws of the Slovak Republic.
6.2 Should any provision of these GCTC be or become invalid, ineffective or unenforceable, this shall not affect the invalidity, ineffectiveness or unenforceability of other provisions of these GCTC.
6.3 By confirming an online reservation, the Customer declares his or her agreement with these T&C and undertakes to comply with them. The Hotel Operator reserves the right to amend these General Terms and Conditions. The obligation to provide written notice of changes to the General Terms and Conditions shall be fulfilled by posting the amended General Terms and Conditions on the website of the hotel operator www.hotelbankov.sk.
6.4 These GTC are valid and effective from 1 January 2019.
